Preamble

These General Terms of Sale ("GTS") govern paid subscriptions to the MyTenue service entered into by any consumer User ("Customer", "you") with MYTENUE SASU ("MYTENUE", "we").

They apply in addition to the Terms of Use and the Privacy Policy. In case of contradiction, these GTS prevail with respect to the subscription and performance of any paid subscription.

A copy of these GTS is made available before order confirmation. Any subscription implies full acceptance of these GTS.

These GTS comply with the French Consumer Code (articles L.111-1 et seq., L.221-1 et seq.) and articles 1130 et seq. of the French Civil Code.


Article 1 — Seller identification


Article 2 — Essential service features

MYTENUE markets subscriptions granting access to various features of the MyTenue service, a mobile and web application for wardrobe management and AI-assisted styling recommendations.

The exact features of each tier are described within the application and on https://mytenue.com prior to subscription.

Prices include the applicable French VAT (20% at the date of publication). Any VAT rate change will be automatically passed through.

Subscriptions are monthly and tacitly renewable, with no minimum commitment. Annual offers at preferential rates may be proposed and described within the application.


Article 3 — Subscription

  2. Account creation or sign-in;
  3. Summary and acceptance of GTS, Terms of Use and Privacy Policy;
  4. Entry of payment means (or validation of Apple / Google account);
  5. Order confirmation;
  6. Confirmation email with invoice.

3.3 Order validity

The order is finally validated upon payment confirmation by the relevant payment provider. MYTENUE reserves the right to refuse any order for legitimate reasons, including prior dispute, suspected fraud or service unavailability.


Article 4 — Prices and payment terms

Prices are stated in euros (EUR), all taxes included, for consumers residing within the European Union.

Payments are secured by Stripe, Apple and Google according to PCI-DSS Level 1 standards. MYTENUE has no access to complete payment card data.

4.4 Invoicing

An invoice is made available in the Customer's Account or sent by email after each charge. Invoices are retained by MYTENUE for the legal period of 10 years.

4.5 Payment default

In case of a payment incident, MYTENUE may suspend access to the Service until regularisation. Multiple charge attempts may be performed by the payment provider, subject to its own conditions.


Article 5 — Service performance

The Service is accessible immediately after payment confirmation and for the entire duration of the subscription.

The Customer expressly acknowledges and accepts that performance of the Service begins immediately after order confirmation and expressly waives the right of withdrawal as described in Article 6 below, save for the specific cases expressly reserved.


Article 6 — Right of withdrawal

6.1 Principle

Pursuant to articles L.221-18 et seq. of the French Consumer Code, the consumer Customer has a 14 calendar day period from the subscription date to exercise the right of withdrawal, without giving reasons.

6.2 Waiver for immediate execution

Pursuant to article L.221-28 13° of the French Consumer Code, the Customer loses the right of withdrawal if the Customer has expressly requested and accepted immediate Service execution and acknowledged the loss of that right.

This express waiver is requested upon subscription via a dedicated checkbox, distinct from GTS acceptance.

Article 7 — Renewal and termination

7.1 Tacit renewal

Pursuant to article L.215-1 of the French Consumer Code, subscriptions are tacitly renewed at each maturity date for the same period, unless terminated by the Customer.

MYTENUE informs the Customer electronically, at the earliest three months and at the latest one month before the end of the period allowing rejection of renewal, of the option not to renew the contract.

7.2 Customer termination

The Customer may terminate at any time from:

Termination takes effect at the end of the current period, with no pro rata refund except where the right of withdrawal has been validly exercised.

7.3 MYTENUE termination

MYTENUE may terminate a subscription for breach of the Terms of Use, under the conditions of Article 11 of the Terms of Use.


Article 8 — Legal warranty of conformity

Under articles L.217-3 et seq. of the French Consumer Code, MYTENUE is subject to the legal warranty of conformity.

In case of non-conformity of the Service, the Customer may request conformity by sending a request to contact@mytenue.com, at no cost and within a reasonable time frame.

If conformity proves impossible or disproportionately costly, the Customer may request a price reduction or contract termination under the conditions of article L.217-14 of the French Consumer Code.


Article 9 — Customer service

Article 10 — Consumer mediation

Pursuant to articles L.611-1 et seq. of the French Consumer Code, the Customer has the option, in case of an unresolved dispute, to refer the matter free of charge to a consumer mediator.


Article 11 — Disputes and applicable law

These GTS are governed by French law.

Failing amicable resolution, any dispute shall be brought before the competent courts under ordinary rules applicable to consumers (article R.631-3 of the French Consumer Code).


Article 12 — Personal data

Personal data collected in the context of subscription is processed in accordance with the Privacy Policy.

The Customer has the rights of access, rectification, erasure, restriction, portability and objection, which may be exercised by writing to dpo@mytenue.com.


Article 13 — Changes to these GTS

MYTENUE may modify these GTS. Substantial modifications affecting an ongoing subscription will be notified to the Customer at least 30 days before entry into force, allowing free-of-charge termination before that date.
